This Site is owned and operated by Wishing Welz Equine LLC, a limited liability corporation incorporated under the laws of Arizona. Wishing Welz Equine LLC maintains this Site for your personal information and education. You may download material displayed on the Site for non-commercial, home personal use only, provided you keep intact all copyright and trademark notices. You may not, however, copy, reproduce, republish, upload, post, transmit or distribute in any way the contents of this Site including the text, images, audio and video for any public or commercial purposes (including any public websites, public mailing lists, public message boards), without written permission from Wishing Welz Equine LLC. All images are either the property of, or used with permission by, Wishing Welz Equine LLC. The use of these images by you, or anyone else authorized by you, is prohibited. Copyright violators will be prosecuted.
When you register for membership, you agree to provide true, accurate, current and complete information as prompted by the registration form, maintain and update such information to keep it true, accurate, current, and complete at all times, and that you are the age that you state. If any information provided by you on the registration form is untrue, inaccurate, not current or incomplete, or if we have reasonable grounds to so believe, we have the right to suspend or terminate your membership and to refuse to provide you with any future membership.
We reserve the right at any time to charge fees for access to Site content or services or to portions of the existing Site content or services or the Site as a whole. In no event will you be charged for access to any Site content or service, or to the Site as a whole, unless we obtain your prior agreement to pay such charges. If you do not consent to such charges, however, you may not have access to paid content or service.
Membership fees are non-refundable, however you can cancel your membership at any time online or by calling us at 1-877-594-3365 and owe nothing further from that date forward.
We have the right to suspend or terminate membership and to refuse to provide any future membership to persons that engage in inappropriate behavior, including but not limited to sending material that is unlawful, slanderous, vulgar, obscene, sexually explicit; material that is under copyright; material containing viruses, junk mail, spam, lotteries and chain letters; persons who impersonate any person or provide a false identity or other misrepresentation, stalk or otherwise harass other members, or violate any state or national laws.
We shall have the right, but not the obligation, to review and edit, delete or refuse to post any material submitted for display or placed on the Site, including but not limited to message board posts, profiles, and member-to-member messages. We shall have the right to remove any material that violates this agreement, that we believe in good faith may create liability for us, or that we deem is otherwise objectionable.
We reserve the right to modify or discontinue, temporarily or permanently, the Site (or any part thereof) with or without notice. You agree that Wishing Welz Equine LLC shall not be liable to you or to any third party for any such action.
All communication and material submitted to this Site, whether hard copy or electronic, including but not limited to, questions, comments, suggestions, photos, videos, data and other information, will be treated as non-confidential and may be used by Wishing Welz Equine LLC for any purpose or future use, including but not limited to advertising, reproduction, publication, communication and broadcasting, or adapting or modifying and incorporating into other forms of media and technology.
Your use of and browsing in this Site is at your own risk. Neither Wishing Welz Equine LLC nor any other party involved in creating, producing or delivering the Site is liable for any direct, indirect, incidental, consequential or punitive damages arising out of your access to, or use of, the Site. Without limiting the foregoing, everything on the Site is provided to you without any warranty of any kind. If you are dissatisfied with the site or the services, content or materials available on or through the site, your sole and exclusive remedy is to discontinue using the site. The foregoing limitations on liability shall be applicable even if Wishing Welz Equine LLC or the applicable third party knew or should have known of the possibility of such damages and notwithstanding the failure of essential purpose of any limited remedy.
This site may contain links to third party websites. Wishing Welz Equine LLC disclaims all warranties, express or implied, as to the accuracy, legality, reliability or validity of any content on any other site and disclaims all responsibility for any loss, injury, claim, liability or damage of any kind resulting from any third party Web sites or content therein directly or indirectly accessed through links in this Site.
You agree to hold harmless Wishing Welz Equine LLC and any other person or entity involved in creating or distributing the Site, as well as each of their respective affiliates and their respective directors, officers, employees and agents, from and against any and all claims, liabilities, damages, losses, costs, fees (including reasonable attorneys' fees) and expenses that such parties may incur as a result of or arising out of your (or, in the case of Members, anyone using your account's) use of, or conduct with respect to, the Site.
Working with horses is inherently dangerous, and your use of any information provided on this site to apply to living horses is expressly at your own risk. You assume all equine risk liability. You also assume all liability for your application of any information provided on this site to your own, or other parties', horses.
